[办证需谨慎]关于“中国 CMMI 认证证书”的澄清声明Clarification Statement on “China CMMI Certification”

近期，个别公司自称“CMMI 认证的中国发证机构”，可以颁发所谓的“中国版 CMMI 认证证书”，甚至主动联系我司业务合作伙伴，建议其申请所谓的“中国 CMMI 认证证书”。有关公司的上述行为已严重误导公众并影响我司的良好声誉。Recently, some companies claiming to be "CMMI certification of China " can issue the socalled "China CMMI certification", and even take the initiative to contact ISACA's business partners, suggesting applying for the so-called "China CMMI certification". The aforesaid acts have seriously misled the public and affected the good reputation of ISACA.鉴于上述情况，我司特作如下声明，敬请各位知悉：In view of the above, ISACA would like to make the following statement for your kind information:1. 我司从未授权或许可标普（成都）认证服务有限公司、中昇德尚检验认证（成都）有限公司、成都成源检测认证服务有限公司提供任何认证服务，上述三家公司声称提供的“中国 CMMI 认证”服务，并非为我司授权，与我司的 CMMI 评估和培训无任何关联。ISACA never authorizes or approves Biaopu (Chengdu) Certification Co., Ltd., Zhongsheng Deshang Inspection and Certification (Chengdu) Co., Ltd. or Chengdu Chengyuan Testing and Certification Service Co., Ltd. to provide any certification service. The "China CMMI Certification" service claimed to be provided by the above three companies is not authorized by ISACA and has no connection with the CMMI assessment and training of ISACA.2. 我司在中国使用和申请注册“CMMI”商标均早于成都成源检测认证服务有限公司申请注册相关 CMMI 商标的时间。根据中国商标法的相关规定，上述主体无权使用“CMMI”商标或在中国提供所谓的“CMMI 认证服务”。ISACA used and applied for CMMI trademarks in China earlier than the time when Chengdu Chengyuan Testing and Certification Service Co., Ltd. applied for CMMI trademarks. According to the relevant provisions of the Chinese Trademark Law, the above-mentioned entities have no right to use the "CMMI" trademark or provide the so-called "China CMMI Certification Services " in China.3. 为维护我司良好声誉，我司已经依法对成都成源检测认证服务有限公司未经授权擅自申请注册的“CMMI”商标提起无效宣告程序，并向有关公司发送律师函，下一步将考虑采取正式的投诉或诉讼手段。In order to maintain the good reputation of ISACA, ISACA has initiated an invalidation procedure against the unauthorized "CMMI" trademark registered by Chengyuan Testing and Certification Service Co., Ltd. in accordance with the law. Furthermore, ISACA has sent a C&Dletter to the relevant companies and will consider filing formal complaints or litigation in the next step.4. 我司在此严正要求标普（成都）认证服务有限公司、中昇德尚检验认证（成都）有限公司、成都成源检测认证服务有限公司以及其他相关主体立即停止有关侵权行为，停止宣传所谓的“中国 CMMI 认证服务”，并停止骚扰我司业务合作伙伴，否则我司保留采取进一步法律行动的权利。ISACA hereby solemnly requests Biaopu (Chengdu) Certification Co., Ltd., Zhongsheng Deshang Inspection and Certification (Chengdu) Co., Ltd., Chengdu Chengyuan Testing and Certification Service Co., Ltd., and other relevant entities to immediately stop the infringements, stop promoting the so-called "China CMMI Certification Services", and stop harassing the business partners of ISACA. Otherwise, ISACA reserves the right to take further legal action.
